a desperate search for two boaters who plunged into the pacific waters and the simple safety tip they missed that could have helped them swim to shore. and we want you to be prepared to beat the heat today. 100 degrees inland, 80s bayside, 70s at the coast. full forecast reveals a cooldown on the way. and your commute heating up as well. this is the south bay. burst of traffic for 101 and two incidents reported for 17. we'll bring you those details coming up. let's take a live look outside. beautiful bay bridge. can you believe it is october? the first monday in october in fact, the 1st of the month. this is "today in the bay." and good monday morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm jon kelley. good morning, everybody. new this morning, safety first. new policy changes go into effect today at a san mateo

elementary school where a young girl was sexually assaulted and then dragged off campus more than a week ago. bob redell is live outside parkside elementary school. bob, we're hearing parents will notice these changes as soon as they drop their kids off this morning? >> reporter: you are correct. good morning to you, jon. some of these changes went into effect last week. all of them will be implemented by this morning and they're all designed to make it as difficult as possible for anyone to get onto campus. one of the most obvious changes is they have added this new gate. all the gates, including this one, are now locked. the idea is they want everyone to be going in through one entrance, and that entrance being the main entrance. they are using that as a choke point to be able to see who's coming and going onto the school grounds. parents are no longer allowed to pick up or drop off their child on campus. they can go to the front main entrance but that's where they say their hellos and goodbyes. anyone who has business on campus must sign in at the main office and wear a visitor badge. it was ten days ago that police

say bradley mrozek followed a 9-year-old student into the bathroom. he groped her and took her to a location off campus covering her mouth along the way. this was around 2:45 in the afternoon. she was able to escape by kicking him and throwing rocks at him. she came back to campus and that's where they called 911. he was arrested a short time later. he is supposed to be in court tomorrow where he could enter a plea to thum russ charges, including kidnapping and child molestation. police say earlier that friday, friday the 21st, mrozek was kicked off another elementary school campus, and near a third campus, police say he offered booze to two students and said something inappropriate to another. reporting live here in san mateo, bob redell, "today in the bay." 6:02. happening now, the search continues this morning for two missing boaters. on sunday night four friends left san francisco in their fishing boat and headed out to

half moon bay. that's when a big wave ran into their boat sending all four overboard. the two men with life jackets managed to swim to shore. the other two without life jackets are still missing this morning. the man accused of killing seven people at an oakland university is set to appear in court today. he's facing murder and attempted murder charges in the shooting spreechlt he's expected to be in court for a pretrial hearing later today. goh was a nursing student at the school when he allegedly opened fire on his classmates and a teacher, killing a total of seven people. a former bay area psychiatrist of accused of molesting seven young patients will be back in court today for a competency hearing. last year prosecutors said william ayers likely had dementia and could not be tried. napa state hospital doctors, they claim he is simply faking the illness to avoid prison

time. police say he molested seven children between the ages of 8 and 13 back in the early '90s. highway 101 is moving smoothly again this morning after a crash and a drive-by shooting turned the busy freeway into a crime scene this weekend. the chp shut down more than three and a half miles in san carlos causing major traffic delays for several hours. investigators say a red dodge charger was driving south on 101 around 3:30 yesterday afternoon when someone drove up beside it and started shooting. the charger crashed into a fence injuring the woman and two others inside. >> right now we have the charger with multiple bullet holes in it and injured occupants. we're still actively investigating this case, so if anyone saw any -- the shooting, anything leading up to the shooting or anything after the shooting, including the crash, we'd appreciate any information we could get. >> all three victims were taken

to the hospital. investigators went to meet with them last night but no information has been released. christina loren has been telling us about soaring temperatures all morning long and they are now being blamed for the death of an elderly woman in concord. the 86-year-old dementia patient wandered off sunday afternoon when temperatures hit about 100 degrees. officers later found her body at fair oaks elementary school. health experts are urging people to stay indoors and stay cool during this big-time heat wave. >> an it continues because the heat prompting another spare the air day for the third day in a row. >> yeah. meteorologist christina loren joins us to take a look at the temperature spike that's going to keep coming. >> may being the hottest of the whole heat wave. we'll stay just about as hot in some cities tomorrow. mostly talking about the inner east bay valleys so temperatures are going to be very hot out in livermore, danville, pleasanton, fairfield.

this morning we are starting out nice and mild. 59 in livermore. kind of cool up in santa rosa, 51 degrees here and 54 in novato. however, temperatures are going to soar, jumping by about 40 degrees in santa rosa before all is said and done today. the reason why, we have this really strong ridge of high pressure. winds are pumping from land to sea and that's a warming trend. they actually warm up and dry out as they pump back to the pacific ocean, so for us today because we're starting out so mild, high pressure is just about as strong as it was yesterday, we are talking about the hottest day. 103 degrees in places like livermore. we also have poor air quality, which means if you don't have an air conditioner in your home and want to open up those windows, right now is the time to do it. close your blinds before you leave and that will help keep your house a little cooler later on today. 103 degrees at 4:00 p.m. inland, 90 degrees bayside. oakland 90. san francisco 80 degrees. we're talking about 70s at the

end of the forecast. let's check your drive, here's mike. we're going back to a shot i showed you a little earlier. this is north 101 with headlights coming into san francisco and the split right by the clock, folks splitting off to the lower deck of the bay bridge, somewhere right past this screen, we couldn't see it, reports of a stalled semi truck so watch that if you're heading to the lower deck of the bay bridge. as the volume starts to increase, a warning there. 101 north of 680 slowing there. we do have one incident, a stalled vehicle south 17 at the summit. this is blocking one lane and it is your commute out of the area out of los gatos and over towards the santa cruz side where some folks are trying to beat the heat today. 880 ves smoothly as well. picking up the volume past the truck scales, no major slowing passing mission and down milpitas. the oracle open world

christie smith "today in the bay." the giants have already clinched their playoff spot and that means they get a head start on firming up that roster for the postseason. bruce bochy says this year all 5 starting pitchers will be on the starting roster with one of the five coming out of the bullpen. that's a big-time departure from back in 2010 where barry zito was kept off of the roster. here's a quick check of the top stories. today new safety measures are in place at a san mateo school where a girl was attacked in the bathroom and then dragged away from campus. all gates to parkside elementary are now locked and visitors must register at the front office and wear a badge. the search continues for two boaters whose vessel capsized in the waters of half moon bay sunday evening. searchers say the men were not wearing life vests when the ship

went down. that search resumes at daylight. an elderly woman is dead after wandering away from her concord nursing home in 100-degree heat. police say they found the 86-year-old woman's body at fair oaks elementary school. high temperatures are expected again today. christina loweren will have our forecast coming up in just minutes. and starting today, hospitals will be giving even more attention to patients before they leave their building. medicare will begin fining hospital that say readmit patients within 30 days of discharge. the penalties are part of barack obama's health care law. this one was designed to improve patient care while saving taxpayer money. medicare will keep track of the 2200 hospitals using this plan to make sure they are following the new rules. fines start off at $125,000 per facility. it is 6:14 right now. same-sex couples are now being considered family members in deportation cases thanks to a new order from the obama administration. the order giving some temporary

relief to couples facing deportation like brian willingham and alfonso garcia from orinda. garcia has been embroiled in a deportation proceeding after a traffic stop last year. house minority leader nancy pelosi praised this move by the obama administration but is urging congress to do away with the defense of marriage act which bars the government from giving federal benefits to married same-sex couples. decision 2012. just a little more than a month away, and this week the presidential debates begin. president obama and mitt romney both preparing for their first debate in denver wednesday night. both sides already planning their post bedadebate rallies. coming up at 6:50, a live report from capitol hill with a look at why both sides are downplaying expectations while at the same time pressuring one another on foreign policy.

all right. let's check in welcome back weather right now. this story here has come up a little bit short so i think we need to change here. >> certainly not the forecast. >> no, the forecast smoking hot. christina loren, you're halving. >> i'd like to give it back to mother nature. as we head throughout the afternoon, it is going to be a scorcher. in fact what's bizarre is that this is actually the second monday of fall and we're talking about the potential for the hottest day of the year. the hottest day of 2012, first day of october. what's interesting is fresno down south, they're expecting the hottest start to the month in over 25 years. just an indication of how unusual it is to see temperatures soar this time of year. hazy sunrise just after 7:04. if you have outdoor activities you need to get done, even if it's just walking the dog, i've got to take my whiskey out because it's going to be downright hot. today will be the hottest of the

heat wave, spare the air if you can. keep that in mind today. we do have unhealthy levels of pollution. minor cooling as we head through tuesday and strong cooling wednesday through friday. by the weekend we're talking about showers, so we've got a really very interesting forecast. we're going to start high and end very low. 59 in san francisco, 61 degrees in san jose to start. look at your new readings. if you break for lunch, close to 90 in livermore at noon with three to four additional hours of warming to go. 81 in san mateo as you break for lunch. 74 in the city at lunchtime so it's going to be very hot in the city by the bay today. tourists might not be ready for this. make sure you're drinking lots of water and staying hydrated. make sure you try to seek that shade whenever you start to feel uncomfortable. 103 degrees in livermore action 90 in fremont, 80 in san francisco. certainly warm enough for heat exhaustion if you're out for any duration today. if you work outdoors, our hearts

go out to you. 96 by tuesday, wednesday we'll get a little more fog and then temperatures will drop off. thursday into friday the heat breaks, we fall below average. then saturday and sunday we have a whole other weekend to talk about. this last weekend, hot and sunny. this coming weekend, cloudy, cool with some north bay showers. 6:18. let's find out how the drive is shaping up. >> good morning. you know, it's so warm in the city, tourists might be prepared and locals are all confused. we're looking over here at a nice smooth northbound slowing a little bit but nice, smooth flow coming up this area. we'll show you where the most impact is for the morning commute so far from 680 up towards 880. that's the volume really building here for northbound 101 as well as 87 over here. bogging down coming into downtown. soon 280 will follow suit. moving up the peninsula, we'll look at palo alto. 101 moves nicely northbound past university shopping center there.

the northbound flow holds steady up through san mateo past the san mateo bridge and into the city without anyin dents. southbound moves smoothly down into the south bay. starting to bunch up around high street and into downtown without any more construction, a smooth drive butt bay bridge toll plaza. the metering lights are on just a few minutes and now the backup in all lanes including the fastrak lanes all the way back to the 880 overcrossing. here, these two lanes with the black diamond, you got the advantage if you car pool, guys. back to you. it is 6:19 right now. this morning, sad but true. we're getting very used to seeing lindsay lohan back in the spotlight for the wrong reasons. she's been involved in another incident involving police. >> at least this time around it looks like there will not be jail time involved. new york city police are actually dropping charges against a man who lohan says assaulted her after an argument at a hotel.

officers say lohan had an argument over the man over photos of her taken on his cell phone. police arrived on scene after lohan pulled the fire alarm, waking up other hotel guests. >> what were they doing? >> they were just in the hallway. i walked out at, say, 6:30 because they woke me up. i went out, came back and they were still there. >> police ended up voiding the arrest saying lohan had only a few scratches on her hands. this is lohan's second incident in as many weeks. she's actually due in court next month for leaving the scene of a car crash. >> and you know it's getting bad when they say at least she didn't go to jail this time. >> isn't it, though? 6:20. coming up, endangered animals in the crossfire of air gun blasts out in the pacific. the plan that could shake up these animals. a struggling sea lion found on the sidewalk. how it got there and the rescue effort under way to save its life. and how about this, a mad

welcome back, everyone. a good monday morning to you. what a beautiful live look outside this morning. christina says it's going to be in the 80s in the city by the bay. quite amazing, high temperatures, the 1st day of october as well. she's coming up in just moments. 6:24. a plan to blast loud air guns right into central coast waters is prompting concern from a lot of animal activists. pg&e wants to shoot 18 big air guns right into the water near diablo canyon nuclear plant to make 3-d maps of underwater fault zones. the company wants to blast strong sound waves into a large area next to the monterey bay national marine sanctuary, including two protected areas, cambria and white rock. activists say the loud sound will hurt dozens of endangered and threatened species in that area. pg&e says it will better help

the company understand seismic threats, like the one that caused that tsunami and nuclear disaster in japan in 2011. 6:25. a stranded sea lion spotted near san diego is being treated at seaworld this morning. the adult female was spotted lying on the sidewalk near the yacht club in point loma. seaworld's animal care team helped rescue that sea lion which looked very weak and underweight. poor thing. once that sea lion gets better, she'll be sent back out to sea. seaworld says it has rescued and cared for 100 marine animals this year. >> with all that heat, i'm sure the thing was so dehydrated. it's lucky they found them. let's check in with meteorologist christina loren. you really have to remember to keep cool. >> yeah, you do because it's unexpected this time of year. traditionally you think of october as a cooler month across the bay area, not the first day. we're talking about potentially the hottest day of the year. we want to start with this live picture of san jose, completely

clear out there. sunrise just after 7:00 a.m. same here over the bay, no marine layer, no natural coolant. throughout the day it's going to be hot as a result. upper 50s, low 60s to start. 103 inland, 90s at the coast, 80 degrees. one of those days you don't want to forget the deodor rant. 880 northbound moves smoothly from the coliseum but southbound, look at all these headlights. the map shows you this is a bad spot for an accident right at a street. there's an accident just out of the shoulder partially into the slow lane causing all this backup for 880 and the ripple effect coming off the castro valley y. into dublin you're okay. also out of livermore. a new accident here causing more backup. back to you guys. europe beat the united states in the ryder cup golf tournament. >> big upset, europe came back. one of the players had a little

time zone mix-up that almost affected the matchup. rory mcilroy had to be rushed to the golf course in chicago by police escort. barely made his tee time yesterday. he got up and stroked it real nice. a golf channel reporter said mcilroy had been watching the network the night before which had been announcing his tee time in eastern time. chicago is about an hour ahead. mcilroy made it to the course just in time with u.s. fans chanting "central time zone." didn't affect him. the europeans won it. 6:27. still ahead, an east bay neighborhood waking up with ringing in their ears. we'll turn about the weekend rave that turned into a noisy nuisance just ahead. ♪

exchange. you can hear that bell right there on wall street as they ring in this monday. yeah, monday the 1st day of october. this is "at thtoday in the bay." good morning, everybody. it is 6:30 on the nose. i'm jon kelley. >> and i'm laura garcia-cannon. a spare the air alert is in effect for the entire bay area today. if you thought yesterday was warm here in the bay area, wait until you see what's headed our way today. >> meteorologist christina loren joins us with a look at this september heat wave carrying right into the 1st day of october. >> yeah, you're not going to get a break until it looks like wednesday when temperatures will finally fall back to average and they keep dropping off into the weekend getting some rain showers. so the roller coaster ride starts tonight. 59 in san francisco, 62 livermore. we're talking about levels of heat that are dangerous later on this afternoon. temperatures are going to soar. right now we're starting out in the 70s in some of your

tri-valley cities. an indication of a very hot day ahead. inland temps will be between the 90s, even 100 degrees plus. watch for dehydration throughout the day today. i posted the signs of heat exhaustion on my facebook page. they're easy to find there. poor air quality adds to respiratory stress. if you have asthma, respiratory issues, stay indoors. elderly, children and pets are the most susceptible. please try to keep your pets indoors today. it's a bad day to take old sparky out to the beach with you because it's going to be even hot in your coastal cities, getting close to 80 degrees in pacifica. i'm forecasting 80 in san francisco today. the warmest time of the day is between 1:00 and 6:00. 103 in livermore, 10 b1 in concore. once the sun starts to set, temperatures drop like a rock and we have a much cooler day starting tomorrow. 5 to 10 degrees cooler, even more so into the week. we'll show you that seven-day

forecast and help you make those plans but today, dress for the hottest day of the summer. 6:32. let's check your drive with mike. >> it's also spare the air day so we're encouraging car pool. that could be a good advantage at the toll plaza as well. looking farther south, looking at southbound 880, an accident at a street, i've circled it. a new accident a little farther south at the 92/880 interchange. big backup there. also feeding back to the castro valley y. also look at this, another accident westbound causing packup coming out of the altamont pass. stirring up things for 580 and now even slowing through sunol. south bay commute is heating up as well. we'll show that to you in the next report. happening now, two bay area fishermen remain missing after their boat capsized off the san mateo coast. marla tellez joins us in san mateo county where crews are resuming that search today.

good morning, marla. >> reporter: good morning. yeah, we're live on highway one right near half moon bay. this is the general area the coast guard spent hours searching by plane and helicopter yesterday afternoon and evening looking for those two missing men. both are from san francisco. one has been identified as 46-year-old king yow sang. he and three of his friends left about 5:30 yesterday morning in a 23-foot fishing boat that ended up washing ashore hours later. now, what happened was officials say about mid-morning a large wave hit the boat causing it to tip over about one mile offshore from the pigeon point light house. the group of four, sang and the other missing man were not wearing a life jacket. the other two were and was able to swim to shore. sang's wife is distraught and desperate for her husband to

come home. >> my husband come back because we are waiting for you. >> we've lost the connection with marla. the coast guard will be resuming their search this morning. certainly it's hard to hear from the family this morning but of course they want their loved ones home. we'll continue to follow the story. 6:34 right now. also new this morning police investigating a shooting that injured at least one person in oakland. this all happened on 7th street between add line add market in west oakland. somebody was shot just before midnight. at this point police are still looking for a suspect and they haven't yet released a motive. closing arguments are expected today in the trial of a

former san francisco crime lab tech accused of stealing drugs. debra madden is accused of skimming cocaine from the city's crime lab back in 2009. those allegations led to the closure of the lab and prompted prosecutors to dismiss hundreds of criminal cases. now, if madden is convicted, she could face up to four years in prison. oakland city officials are still apologizing for a weekend dance party at the coliseum that prompted a long list of people to start calling 911 and they were doing it often. the beyond wonderland event was held in the parking lot of the coliseum saturday night. this is youtube video from that party. oakland police officers say the music from the event was so loud people from san leandro to alameda were actually calling 911 to complain about all the noise. oakland city and coliseum officials releasing a statement after the event apologizing to residents. it says in part, while adjustments to the sound were made following the afternoon's sound check, they were clearly

not sufficient to control the impact upon residents of our closest cities. we are committed to undertaking an immediate review of the situation to help us create new procedures for the management of audio production. 6:36. starting today, san francisco is strictly is byob, bring your own bag. today plastic bags are banned from all retailers. not just grocery stores and chain pharmacies. businesses will have to charge customers ten cents for any other type of bag they hand out. restaurants are exempt, but only for the next year. laura, what some thought might be a dreaded sequel ended up being a smooth ride after all. the 405 freeway now open to traffic after a closure. police escorted the first wave of cars overnight as drivers literally cheered out there and honked their horns with the success. initially drivers a little skeptical that the freeway would open on time after a huge chunk

new this morning, a total of three u.s. soldiers are now among the 14 killed following a suicide bomber attack. this all happened in the province in eastern afghanistan. that's near the pakistan border. the military says the bomber drove his explosives-packed motorcycle right into their patrol as they were walking through a market. several dozen civilians were also injured. the taliban is claiming responsibility for this blast. the boy scouts of america says it will inform police and

6:44. parents at a san mateo elementary school will notice some changes today. new safety measures are in mace to protect students less than two weeks after a girl was molested and dragged from the campus. bob redell joins us live at parkside elementary with more on those changes. >> reporter: good morning, laura. parkside elementary has been implementing these new security measures since the abduction friday the 21st. they're all supposed to be in effect by this morning. one very obvious, they have installed a new gate and locked it. they have locked all the gates on campus, basically making it very difficult for anyone to get on the campus without being obvious about it. they have also restricted access to the campus through just the main entrance so it's basically a choke point so the school can keep tabs on who's coming an going. parents are no longer allowed t

drop their child on campus or pick them up on campus. they have to drop them off up front. if anyone has business on campus, they must sign in at the front office and wear a visitors badge. now, these are in response to the abduction that took place ten days ago. police say bradley mrozek of san francisco followed a 9-year-old student into the bathroom, groped her and took her to a location off campus, covering her mouth so she couldn't get someone's attention. this is around 2:45 in the afternoon. once off campus, she did kick the man, threw rocks at him and was able to escape. she made it back to the school where they called 911. he was arrested. he is expected to be in court tomorrow to answer charges against him. earlier that friday mrozek was kicked off another elementary school campus because he was acting suspicious and near a third campus not far from parkside he offered booze to two

students and said something inappropriate to another. reporting live here in san mateo, bob redell "today in the bay." opening statements are set to begin in the murder tile of gisele esteban. she's accused of killing nursing student michelle le and dumping her body between pleasanton and sunol in may of last year. le's body was eventually found nearly four months later. prosecutors say esteban blamed le for wrecking her relationship with a former boyfriend. that trial is expected to last about a month. 6:46. a mom accused of ditching her daughter during a shoplifting attempt is about to be brought back to the bay area. officers will likely bring 38-year-old marcy keelin back to the bay area this week from nevada. officers arrested her in a motel in the city of fernly late friday. keelin is accused of using her 10-year-old daughter as an accomplice during a shoplifting attempt at a morgan hills safeway.

let's find out how we're doing on the roads. good morning, mike. >> good morning. a hot day ahead, warm already and we have bad traffic flow as well. south 880 look at this coming out of oakland down toward that san mateo bridge. we've had three separate accidents in the last 40 minutes. the latest actually around tennison causing quite a bit of backup. slow south 880 into fremont where the build is on heading into milpitas. on this side we do have slow southbound 680 off of the dublin interchange. another accident in livermore holding folks up coming over off of the altamont toward first. the south bay, north 101 north of 880 slowing through santa clara in towards sunnyvale and mountain view. already jamming up from capital up towards 680 and 87. 85 also building as well. we'll look at palo alto, a live look for 101 as the traffic starts to build, but still speeds holding up close to the

limit. coming up into the city as well and san rafael starts to build as well southbound. remember those speed teams between novato and san rafael. just a note. back to you. >> okay, mike. thank you for the heads up. happening right now, a long list of bay area families not giving up hope search crews will find their loved ones alive. their boat capsized during a fishing trip. marla tellez joins us now live on the phone along the san mateo coast. she has an update on all the rescue efforts out there. marla, good morning. >> reporter: jon, good morning. officials say their boat capsized about one mile offshore from pigeon point light house which is about 20 miles south of half moon bay which is where we're coming to you live from this morning. for the most part the search has been suspended overnight but the coast guard is expected to launch its helicopter and plane at daybreak today. officials say 46-year-old king yow sang is one of the missing men.

he and three friends took off from san francisco in their 23-foot fishing boat about 5:30 yesterday morning. mid-morning their boat capsized after getting hit pby a powerfu wave sending all four into the chilly waters. two of the men were wearing life vests and were able to swim to shore to get help. sang and the other friend were not and this morning they are still missing. both are from san francisco. i spoke to his sister on the phone this morning. she says sang is an avid fisherman and knows what he's doing. >> he know how to swim. i hope he just somewhere around the ridge. >> reporter: she tells me sang is married with a 7-year-old daughter. as for the search, the coast guard is focusing on about 40 square miles off the san mateo county coast. also getting help from the san ma tear owe county sheriff's department. sang's sister says the coast guard will resume their full-fledged search soon after sunrise today and she says she is going to be here when they do. live along highway 1, marla
